The committee determined prerecorded telephone or electronic mail messages from institutional staff members sent to individuals through services that allow such messages to be sent to any member of the general public are not considered to be initiated by the institution and therefore, are not subject to NCAA recruiting legislation, provided:

(a) The message is sent by an individual other than an institutional staff member or a representative of an institution's athletics interests;

(b) The institution does not direct the individual to initiate the message; and

(c) The message does not include athletically related information or other information related to the institution.
